General conditions of use and sale
These general conditions regulate (A) the use by the user (“ User ”) of the website https://panificiogiuntini.it (“ Site ”) made available by Panificio Giuntini di Nicola Antonio Giuntini Sas , with registered office registered office in Quarrata (PT), via Cino da Pistoia 37 - 51039, tax code and VAT number IT02004910473, registered in the Companies Register of Pistoia, REA no. 600909 (“ Panificio Giuntini ”), as well as (B) the provision by Panificio Giuntini to the User:
of the products available for sale on the Site (“ Products ”), in accordance with the following conditions of sale;
of any ancillary services necessary for the delivery of the Products (“ Services ”), in accordance with the following conditions of sale.
A. Terms of use of the Website
1. User Registration
The Site is freely available on the Internet, without prejudice to the limitations imposed by the User's browser or navigation interface.
The User must register on the Site before purchasing the Products online . To complete registration on the Site, the User must (a) create an account by entering the requested data; (b) read and accept these terms and conditions; and (c) read the privacy policy , providing relevant consent, if necessary.
By accepting these terms and conditions, the User represents and warrants that all information provided is true and accurate and undertakes to keep it up to date and correct.
2. Use of the Site
The use of the Site is personal and therefore the User undertakes not to disclose their access credentials to third parties. The User undertakes to take all necessary precautions to ensure that the password remains safe and confidential and undertakes to change it and to immediately inform Panificio Giuntini in the event that he has reason to believe that third parties are aware of the password , or in the event where the password is, or is alleged to be, used in an unauthorized manner. The User acknowledges and accepts, to the extent permitted by applicable legal provisions, to be responsible for all activities that will be carried out through the Site with their account and password . The User must not use the Site in a way that causes interruptions, malfunctions to the Site and/or the services provided through the Site, or for fraudulent purposes, to commit illegal activities, or to cause damage. Panificio Giuntini reserves the right to prevent access to the Site and/or to suspend or close the User's account if the latter's behavior constitutes a justified reason for doing so. This will happen, in particular, in case of violation of the applicable rules and contractual provisions.
The User must be at least 18 (eighteen) years of age to use the Site. The Site is not intended and is not suitable for use by minors, and Panificio Giuntini will not be held responsible for any use of the Site in violation of this clause.
Access to the Site may result in costs being charged by third parties, such as Internet service provider fees or other costs, which remain the responsibility of the User.
3. Intellectual property rights
The intellectual property relating to the Site, its features and/or the information contained therein (including, by way of example and not limited to, notices, disclaimers , data, text, audio, images, graphics, video, software, processes, distinctive signs , codes or other material) belongs to Panificio Giuntini or third parties who have granted Panificio Giuntini the related economic exploitation rights. You agree not to modify, distribute, decrypt, perform, copy, reproduce, transfer, transmit, display, publish, license, create derivative works from, sell or resell any information, software, branding, products or services obtained from or through the Site.
B. Conditions of sale of Products and provision of Services
1. How to purchase the Products
To purchase a Product, the User must place an order (“ Order ”).
Orders can alternatively be placed in the following ways:
via the Site;
by contacting Panificio Giuntini, sending a message on WhatsApp or calling the following number: 0039-0573 72237, from Monday to Saturday, from 6.30 to 13.30
at the Panificio Giuntini shop, in Quarrata (PT), in via Cino da Pistoia, 37 - 51039
After receiving the Order, Panificio Giuntini may - at its sole discretion - accept or refuse it.
The contract between the User and Panificio Giuntini relating to the Products (“ Contract ”) ends with written confirmation of acceptance of the Order, regardless of the manner in which the Order was placed. The conclusion of the Contract is also subject to the payment by the User of the price of the Product and acceptance of these terms and conditions.
The availability of a Product on the Site and/or in the store does not constitute a contractual proposal.
2. Price of the Products; terms of payment
The price of the Products is that indicated on the Site and includes VAT.
With reference to Orders placed pursuant to art. 1 (a) of these conditions of sale, the price of the Products may be paid with the following means of payment:
bank transfer to the bank details that will be communicated, upon request of the Customer, by Panificio Giuntini after acceptance of an Order that provides for this means of payment;
credit cards (those accepted by Panificio Giuntini, as indicated on the Site);
buy-now-pay-later services available on the Site, provided that the User accepts the terms and conditions of the third parties offering such services.
With reference to Orders placed pursuant to art. 1 (b) and (c) of these conditions of sale, the price of the Products can be paid by bank transfer or credit cards (those accepted by Panificio Giuntini, as indicated in the store).
Regardless of the payment method chosen by the Customer, Panificio Giuntini will schedule the delivery of the Products only upon receipt of the price.
3. Delivery of the Products
Panificio Giuntini makes every reasonable effort to select the best couriers to deliver the Products to Users who have purchased them in accordance with these conditions of sale, to the address communicated by the User when registering on the Site or to a different address that will be communicated promptly and, in any case, before the delivery has been scheduled.
Upon acceptance of the Order and receipt of payment, Panificio Giuntini will share information relating to the courier with the User, if available. As a rule, Users will be able to monitor the delivery of the Products.
In case of problems relating to the delivery of the Products, the User can contact the courier directly.
The User acknowledges that Panificio Giuntini is unable to deliver the Products, due to applicable restrictions, in these countries . Both parties may withdraw from the Contract without notice in the event that the User requests delivery to such countries, it being understood between the parties that in this regard Panificio Giuntini will not be responsible for any loss or damage suffered by the User.
The User further acknowledges that the list of countries to which the Products will not be delivered is subject to change, which reflects any updates to the applicable legislation; therefore, the User undertakes to regularly monitor the list at the link provided to him, and in any case before placing the Order.
4. Customs duties
In case of delivery of the Products outside of Italy, the User may be subject to import duties and taxes, payable once the Product reaches the destination. Any additional customs clearance costs will be borne by the User.
Panificio Giuntini has no control over these costs and cannot predict their amount. Customs policies vary greatly from country to country, so you should contact your local customs office for further information.
You further acknowledge that when you place Orders on the Site, you are considered an importer and are therefore required to comply with all laws and regulations of the country in which you will receive the Products.
5. Right of withdrawal
The User has the right to withdraw from the Contract within 14 (fourteen) days of purchasing the Product pursuant to and in the forms set out in art. 52 of Legislative Decree 206/2005, provided that the Product has not been damaged in any way and that it is returned together with all documents and packaging that were provided to the User at the time of delivery.
In this case, the User is entitled to a refund of the price of the Product.
The notice of withdrawal can be forwarded to Panificio Giuntini via e-mail at ordini@panificiogiuntini.it. Alternatively, the User may send a registered letter with return receipt to the address indicated in the epigraph or a certified email message (" PEC ") to the address panificiogiuntini@pec.it, unequivocally expressing the desire to withdraw from the Contract. The User can use the following withdrawal declaration form, duly completed: " I, the undersigned [______] declare to withdraw from the contract concluded on [______] between me and Panificio Giuntini di Nicola Antonio Giuntini sas , relating to the Product [______] ".
6. Customer service
Panificio Giuntini makes customer service available to Users via WhatsApp or by telephone from Monday to Saturday, from 6.30am to 1.30pm.
7. Legal guarantee; limitations of liability
In relation to the Products, the User benefits from the legal guarantee of conformity to which Panificio Giuntini, as a seller, is required by law (" Legal Guarantee "). The Legal Guarantee guarantees the Products against defects in conformity with the descriptions viewable on the Site or on Panificio Giuntini's social network accounts, or with respect to the Contract, granting the User the remedies provided by law. The User must report the lack of conformity within two months of discovery. Panificio Giuntini is not responsible in the event of non-existent differences between the Products and the descriptions displayed on the Site or on Panificio Giuntini's social network accounts.
Except in the case of willful misconduct or gross negligence, Panificio Giuntini is responsible exclusively for direct and foreseeable damages at the time of conclusion of the Contract. Therefore, Panificio Giuntini will not be responsible for any losses suffered, lost profits or other damages that are not an immediate and direct result of its violation or that were not foreseeable at the time of the conclusion of the Contract.
Panificio Giuntini is in no way responsible for the fulfillment of obligations towards third parties, such as - in particular - the User's customers.
8. Processing of the User's personal data
In the formation and execution of the Contract, some personal data of the User is collected, including, by way of example, name and surname, address, telephone number and e-mail address. The User's personal data is processed for the execution of the Contract and for the other purposes listed in the privacy policy , subject to the User's explicit consent or other legal basis for processing specified therein.
The User has the right, at any time, to obtain information on the storage status of their personal data and to request its deletion to the extent permitted by applicable law. The procedures for exercising your rights under applicable data protection legislation and other relevant information are contained in the privacy policy .
9. Changes to the conditions of sale
Panificio Giuntini reserves the right to modify the Site and these general terms and conditions at any time to offer new products or services, or to comply with legal requirements. The Contract will be governed by the terms and conditions in force at the time the Contract is concluded, unless changes are required by applicable law or competent authorities. If any provision of these terms and conditions or of the Agreement is held to be invalid or for any reason unenforceable, such provision shall however not affect the validity or unenforceability of the other provisions.
10. Applicable law; Jurisdiction
These general conditions and the Contract are governed by Italian law. If the User is a citizen of the European Union, the consumer protection provisions of the Member State of residence of the User will apply. In any case, the application of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention of 11 April 1980) is expressly excluded. Any dispute relating to the interpretation or execution of these terms and conditions or the Agreement will be subject to the exclusive jurisdiction of the court in which the User resides.
